By creating an account, accessing, or using SmartReader: Learn English, you agree to these Terms and to the App Privacy Policy.

If you do not agree, do not create an account or use the application.

If you use the application on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.

3. Eligibility

SmartReader: Learn English is intended for users aged 13 and older.

If you are below the age at which you may independently consent to online services in your country, you may use the application only with the authorization of a parent or legal guardian.

4. The service

SmartReader: Learn English provides educational functions that may include:

• English reading materials and interactive stories.
• Translation, pronunciation, and vocabulary tools.
• Listening and shadowing exercises.
• Speaking and Voice Tutor activities.
• Quizzes and grammar explanations.
• AI-assisted story creation and adaptation.
• Synchronization of learning progress between devices.

Features may vary by device, operating system, region, application version, account type, or subscription status.

5. Accounts and account security

Some features require an account. You agree to provide accurate information and to keep your sign-in credentials secure.

You are responsible for activity performed through your account unless the activity results from a security failure for which we are legally responsible.

Notify us promptly at support@smartreaderenglish.com if you believe your account has been accessed without authorization.

You retain your rights in text, stories, prompts, recordings, and other content that you submit to the application.

You grant us a limited, non-exclusive license to host, reproduce, transmit, process, and technically modify your content only as necessary to:

• Provide the functions you request.
• Synchronize content between your devices.
• Process content through our service providers.
• Maintain security and prevent misuse.
• Comply with applicable law.

You confirm that you have the rights needed to submit your content and that its use through the application does not violate the rights of another person.

7. Acceptable use

You must not use the application to:

• Break applicable law or encourage unlawful conduct.
• Submit content that infringes copyright, privacy, or other rights.
• Upload malware, harmful code, or content intended to disrupt the service.
• Attempt to bypass authentication, access controls, usage limits, or security systems.
• Access another user's account or data without permission.
• Abuse AI, speech, translation, storage, or backend functions.
• Use automated systems to overload, scrape, or reverse engineer the service except where applicable law expressly permits it.
• Submit content involving exploitation of children, credible threats, or other seriously harmful conduct.

We may restrict access where reasonably necessary to protect users, the service, our providers, or legal rights.

8. Artificial intelligence features

AI-generated stories, translations, explanations, questions, corrections, transcriptions, and tutor responses may contain errors or unexpected results.

AI output is provided as an educational aid. It is not guaranteed to be accurate, complete, original, or suitable for a particular purpose.

Do not rely on AI output as medical, legal, financial, safety, or other professional advice.

You are responsible for reviewing AI-generated content before relying on, publishing, or sharing it.

9. Free and paid features

The application may offer free features, Premium features, free trials, subscriptions, or other purchases.

Where a purchase is offered through Google Play or the Apple App Store:

• The applicable store processes the payment.
• Prices, taxes, renewal periods, and trial conditions are shown before purchase.
• Subscription management and cancellation are handled through your store account.
• Refund requests are handled according to store rules and applicable consumer law.

Deleting the application or your SmartReader account does not automatically cancel an active app-store subscription. You must cancel it through the store account used for the purchase.

Nothing in these Terms limits mandatory consumer rights available under applicable law.

10. Intellectual property

The application, software, visual design, branding, databases, original educational materials, and other service content are protected by intellectual-property laws.

Except for the limited right to use the application under these Terms, no ownership rights are transferred to you.

You may not copy, sell, sublicense, redistribute, or create unauthorized derivative versions of protected application content.

11. Third-party services and content

The application relies on services provided by companies such as Google, Firebase, Apple, and AI service providers.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control, but this does not limit any responsibility that cannot legally be excluded.

12. Availability and changes

We aim to provide a reliable service, but continuous or error-free availability is not guaranteed.

We may update, improve, replace, suspend, or discontinue features for technical, security, legal, commercial, or operational reasons.

Where required by law, we will provide appropriate notice of material changes that negatively affect an ongoing paid service.

13. Account suspension and termination

You may stop using the application at any time and may delete your account through the application or the Account Deletion page.

We may suspend or terminate access where reasonably necessary because of:

• A serious or repeated violation of these Terms.
• Fraud, abuse, or a security threat.
• A legal requirement.
• Discontinuation of the service.

Where appropriate and legally required, we will provide notice and a reasonable opportunity to respond.

14. Warranties and statutory rights

The application is provided with reasonable care and skill. However, educational and AI-generated results may vary.

To the maximum extent permitted by law, we do not promise that the application will always be uninterrupted, error-free, or compatible with every device.

These Terms do not exclude legal guarantees, remedies, or other mandatory rights that apply to consumers.

15. Limitation of liability

To the extent permitted by law, we are not liable for indirect or unforeseeable losses resulting from use of the application.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot legally be excluded.

16. Governing law

These Terms are governed by Austrian law, without regard to its conflict-of-law rules.

If you are a consumer, this choice does not deprive you of mandatory protections available under the law of the country in which you usually reside.

Any mandatory right to bring proceedings before the courts of your country of residence remains unaffected.

17. Changes to these Terms

We may update these Terms when the application, law, business model, or service providers change.

The current version will be published on this page. Where required, we will provide additional notice before material changes take effect.
