These Terms apply to the SmartReader website at smartreaderenglish.com.

Use of the SmartReader: Learn English mobile application is governed separately by the App Terms of Use.

The SmartReader website provides information about the SmartReader: Learn English application, its educational features, development status and planned availability for Android and iOS.

The mobile applications are functional and are currently undergoing testing and preparation for public release.

The website itself does not currently create user accounts, provide access to the application account, process payments or sell subscriptions directly.

3. Application availability

Application-store buttons or references marked “Coming soon” are informational until the corresponding public store listing becomes available.

Such references do not guarantee that the application is already publicly available in a particular store, country, language, device category or operating-system version.

Availability, functionality and release dates may change during testing, store review or continued development.

4. Permitted use

You may access and use the website for lawful personal, informational and non-commercial purposes.

You must not:

• use the website in violation of applicable law;
• attempt to gain unauthorized access to the website, hosting infrastructure or related systems;
• interfere with the operation, availability or security of the website;
• introduce malware, harmful code or automated requests intended to overload the website;
• copy, republish or commercially exploit protected website content without permission;
• misrepresent an association with SmartReader or the website provider.

Reasonable care is taken to keep the website accurate and current. However, SmartReader is under active development, and product features, screenshots, illustrations, descriptions, prices, availability and technical requirements may change.

Website descriptions are general product information and do not guarantee that every described function is available on every platform, device, account type, language or application version.

Unless otherwise stated, the SmartReader name, website design, original text, application screenshots, illustrations, logos, graphics and other original materials are protected by applicable intellectual-property laws.

Access to the website does not transfer ownership of any intellectual-property rights.

Protected materials may not be copied, modified, distributed, published, sold, licensed or commercially reused without prior permission, except where applicable law expressly permits such use.

The website may contain links to third-party websites and services, including Google Play, the Apple App Store, Google, Firebase, Cloudflare or social-media platforms.

Third-party services operate under their own terms, privacy policies and technical conditions. We do not control third-party websites and are not responsible for their content or availability.

We aim to keep the website available and secure, but continuous, uninterrupted or error-free availability cannot be guaranteed.

Access may be temporarily restricted because of maintenance, technical problems, security incidents, hosting-provider issues or circumstances outside our reasonable control.

To the extent permitted by law, we are not responsible for indirect or unforeseeable losses resulting solely from use of, or inability to access, this informational website.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for intentional misconduct, gross negligence, fraud, or death or personal injury caused by negligence.

Nothing in these Terms limits mandatory consumer rights available under applicable Austrian or European Union law.
